„We,“ „we“ and „our“ refers to Oracle America, Inc., for and for itself and its subsidiaries and related companies under common control. „You“ and „your“ refers to the individual or legal person who wishes to use Oracle`s programs. „Program“ refers to the software product related to this agreement, which you want to download and use, and program documentation. „Developer Desktop Computer“ refers to your physical computer, to which only one person (each „your developer“) is accessed and used for software development and testing purposes and does not participate in a common development environment for program usage. A developer desktop can host one or more virtual computers containing programs for your developer`s exclusive use. „Shared development environment“ refers to software development in a network or IT infrastructure shared by multiple people; and/or (b) software development on a computer that should not be used only by your developer. „Component testing“ refers to the testing of one or more computer program modules that bring together part of an application at the same time as control data, usage procedures and operating procedures to determine whether these computer program modules meet operational objectives. „Licence“ refers to your right to use the programs in accordance with the terms of this Agreement. Oracle licenses and limitations grant you a limited, non-exclusive, non-transferable license for the internal use of programs, subject to the restrictions set out in this Agreement, exclusively for your business activities and any third-party training in these transactions. You may allow your contractors to use the programs, provided they act on your behalf to exercise the licensing rights granted in this Agreement and that you are also responsible for compliance with this Agreement when using it. You have a written agreement with your partners that strictly limits their right to use the programs and also protects Oracle`s intellectual property rights to the same extent as this agreement. They may make copies of the programs to the extent that it is appropriate for the exercise of the licence fees granted in this agreement.
