Alliance Pipeline is federally regulated by the National Energy Board (NEB) in Canada. The National Energy Board Act and its regulations, the National Energy Board Pipeline Damage Prevention Regulations, Authorization and Obligations, require a crossover agreement for anyone who proposes to cause soil disturbance in the prescribed area, which extends vertically 30 metres on both sides of the pipe median line; Build a facility on, on, along, along or under an oil pipeline; or cross a pipe with a vehicle or mobile equipment. A crossing agreement can be obtained from the pipeline operator. AUTHORITY AND ACTIVITIESThe Windsor-Detroit Bridge Authority (WDBA), founded on October 9, 2012, under Order in CouncilP.C. 2012-1350, is a Crown Corporation that is listed in Part I of the Financial Administration Act (FAA) and is not subject to income tax under the provisions of the Income Tax Act. WDBA was created in accordance with the crossing agreement signed by the Government of Canada and the State of Michigan on June 15, 2012. These are aimed at maintaining the ongoing control of WDBA`s compliance with the agreement with the public-private agreement. Failure to comply with this NEB regulatory requirement can now result in fines of up to $100,000 per day and an infringement by the NEB`s administrative fines authority. MDOT will be responsible for maintaining the exchange; WDBA assumes no additional responsibility for the exchange or its participation. The Crossing Agreement also created the International Authority, a separate legal entity from WDBA.
